1. Acceptance of Terms

By accessing or using AttendFlow ("the App"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the App.

2. Description of Service

AttendFlow is a software-as-a-service (SaaS) offering comprising a mobile application and related web services. The service helps users track attendance, manage class schedules, organize academic data, and monitor academic progress. The service is provided on a subscription basis: a free tier with limited features and a premium tier with expanded capabilities. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice where practicable.

3. User Accounts

3.1 Account Creation

• You must provide accurate, current, and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

• You must be at least 13 years old to use the App
• If you are under 18, you must have parental consent to use the App
• You must have the legal capacity to enter into these Terms

4. Subscription Plans and Payments

4.1 Free Plan

The App offers a free plan with limited features. Free plan limitations include:

• Up to 5 subjects
• 30 days of attendance history
• Up to 10 calendar events per month
• Limited attendance records
• No export or sharing features

4.2 Premium Subscription

Premium subscriptions provide access to all features, including:

• Unlimited subjects, events, and attendance history
• Export and sharing capabilities
• Advanced analytics and absence detection
• Ad-free experience
• Cloud backup and sync

4.3 Payment Terms

• Subscriptions are billed through Google Play Store
• Monthly subscriptions are billed monthly on the date of purchase
• Yearly subscriptions are billed annually on the date of purchase
• Prices are displayed in your local currency and may vary by region
• All payments are processed by Google Play Store, not by us directly

4.4 Subscription Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can cancel your subscription at any time through Google Play Store settings
• Cancellation does not entitle you to a refund for the current billing period
• You will continue to have access to Premium features until the end of your current billing period

5. Acceptable Use and Usage Limitations

5.1 Permitted Use

You may use the service only for personal, non-commercial purposes related to attendance and academic management. You agree to use the App and website only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers connected to the App
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App to transmit any malicious code, viruses, or harmful data
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5.2 Usage Limits and Fair Use

Your use of the service is subject to the limits of your chosen plan (free or premium). Excessive use that degrades service quality for other users, circumvents plan limits, or abuses system resources may result in throttling, suspension, or termination. We may set and enforce reasonable usage limits to ensure fair access for all users.

5.3 Content Responsibility

You are solely responsible for all data and content you input into the App. You represent and warrant that:

• You have the right to input such content
• Your content does not violate any third-party rights
• Your content is accurate and not misleading

6. Intellectual Property

6.1 Our Rights

The App, including its design, features, functionality, and content, is owned by AttendFlow and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

6.2 Your Rights

You retain ownership of all data and content you input into the App. By using the App, you grant us a license to store, process, and display your content solely for the purpose of providing the App's services.

7. Data and Privacy

Your use of the App and website is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, including cookies, analytics, and advertising on our website. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

We strive to provide reliable service but do not guarantee that the App or website will be available at all times, uninterrupted, or error-free. The service may be unavailable due to maintenance, updates, third-party outages, or circumstances beyond our control. Scheduled maintenance will be communicated where practicable. We do not guarantee uptime or availability of any specific percentage.

8.2 Data Accuracy and Backup

While we make efforts to ensure data accuracy and integrity, we do not guarantee the accuracy, completeness, or reliability of any information in the service. You are responsible for verifying the accuracy of your data. We recommend that you maintain your own backups of critical data. We are not liable for data loss resulting from user error, service interruption, or circumstances beyond our control.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTENDFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

8.4 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless AttendFlow and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the App or violation of these Terms.

10. Termination

10.1 Termination by You

You may stop using the App at any time. You can delete your account and data through the App settings.

10.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent, abusive, or illegal activity
• Fail to pay subscription fees when due
• Use the App in a manner that could harm us or other users

10.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending you a notification through the App (for material changes)

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in India.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AttendFlow regarding your use of the App and supersede all prior agreements and understandings.
